When I wrote the thread I was going to have the the words in capital. When I submitted that's how it came out, every word was capitalized. So I left it. Once they understand.

I appreciate the sentiment, but the letter (and proving our case) is going to be much more work than I imagined, and the odds are stacked quite heavily in EA's/NFL's favor. Essentially, an anti-trust lawyer/litigator will have to take a look at a number of documents for our efforts to bear fruit.

So far that I can see, at least a half dozen criteria have to be met in order for our greivance to have any merit, some of which will be very difficult:

1) That EA's acquisition of NFL game simulation violates the "Clayton Act".

2) That said acquisition of NFL gaming rights has harmed the consumer.

3) That EA has "price fixed" NFL simulation and rigged the bidding of NFL gaming rights in a way that is illegal, and violates Antitrust statutes, requiring enforcement by the US Department of Justice.

4) Multiple grievances will need to be filed with the Citizen Complaint Center of the Antitrust Division (for future reference I am including the information of said center here):

5) That EA and the NFL colluded in secret to deprive companies such as 2k Sports (and others) the right to produce an NFL or NCAA football simulation.

6) That EA's right to "first bid" on future NFL gaming contracts is illegal and also constitutes "bid rigging".

A number of these points should be easy to prove, while some will clearly be hard. I think however that if we set pursue the work dilligently, we can try and get actual criminal charges pressed against EA and the NFL.

Such criminal malfeasance could potentially cost EA and the NFL millions of dollars in penalties and fines. I only hope there is someone at the DOJ willing to listen to our petition.

I don't think we should try anything just yet, however well intentioned. Better, I think, to go about this as methodically as possible, using the legal tools that are available to protect us from large corporations doing just what EA/NFL did. Once I get a handle on what actions we can take, if any, I will gladly post them on these forums. Remember, EA/NFL have hundreds of lawyers working for them, and millions of dollars to spend on a defence against this type of action, so if you think a few letters to the DOJ or your state attorney are going to make a difference, you are sorely mistaken. This could take years just to assemble enough momentum.

In the meantime, if anyone has a friend or family member who is versed in corporate litigation, please try and get their opinion as to what the most prudent effort may be.

I will begin drafting a form letter sometime around the 10th of june, once I have a little bit more time on my hands.
