View Full Version : CLASS ACTION SUIT WARRANTED?

For starters, I think the prices of games for consoles has gotten out of control! I appreciate the fact that the technology has advanced and can give us more realism in game play. However, $60 for incrementally improved games and games that do not go through proper QA is inexcusable and abusive.

In this case, MLB 2K6 for the 360 does not appear to be a dramatic change in game and where it is, it is either too difficult or unplayable. In many instances, the components of the game that should be quite standard by this time (jerseys, players, etc.) should be flawless.

Further, the system lock ups that are apparent in this game are inexcusable. How in the world did this game pass QA as to not realize problems with systems having hard drives installed! As the 360 has been available since November, I would have hoped the game would have been tested with other content resident on the hard drive and with many different configurations.

For us to now have to wait until sometime 'real soon' for a fix should not be acceptable. We should have an option to return the game for a full refund. If we choose to repurchase it after the issue is resolved should be our option. We bought something in good faith and I don't believe the software developers and producers have lived up to their responsibility. As such, we should be able to return it for breach of trust and not have to fund the revenue stream and bug fixing. I'm out $60 and am not getting from the game what was promised.

And lastly, I had to dig hard into the this website to find acknowlegement of this issue. I would expect the least 2ksports could do is put the issue prominently on their website so that we know about it without having to repeatedly report the issue.

I love it when people complain about $60 video games.

Because they obviously don't remember the N64 days.

I didn't own a 64 because of that, but I willing bought a 360 knowing the pricing would be 10 bucks more. I don't really have too much of an issue with it, but I don't think there is a real reason for it. The 64 games were 60 or 70 bucks due to the fact they still used carts. The 360 has yet to give a reason as to why. At least Nintendo had a reason.

I love my 360 and I chose to buy a system I knew would have games that cost 10 dollars more. My only complaint with the extra cash is I don't feel I'm getting enough of an improvement. But hey, first gen games on a new system are usually a let down and it isn't until year two we really start to see devolpers push the systems strengths.

The problem is we paid 60 dollars for a coaster not a video game. The price isnt the issue here its the game doesnt work for some of us, no matter what you try it still doesnt work. I think if the game was playable, the 60 dollars wouldnt be the issue. The lack of updates by the admins is horrible its like they post and then disapear without saying anything on what is happening. Well we know they are looking into the issue but the generic responses from them are getting a little old. Something new in those lines would sure be useful.

I agree with that entire statement. I would like some update. The Mods here clearly don't work with or know anything about whats going on with the patch. I just wish they'd allow me to get a refund. That's what sucks. Nobody will take it back. They just say exchange for the same game and that doesn't fix the problem since the problem is in the game itself.

^^^Thats the way it works, thank software pirates for that... BTW a class action lawsuit? We would all get $10 each, and a copy of the game, which you already paid for... those are so worthless... Just have patience, maybe find something else to worry about, and dont sweat it

I said it yesterday. They are NOT working around the clock on this. 5PM Friday is, "Have a great weekend, see you Tuesday!" They clearly, by their methods and posts, do not take this as seriously as they should, and this is not the top priority for them. That much is clear. Regardless of what they claim.

A class action lawsuit in this case would not be for money per se; rather, it would be a statement by baseball gamers that we will not put up with this type of mediocrisy. Perhaps the developers will open thier ears a tad-bit more when money is being pulled from there accounts?

With that being said, my game is flawless -- I've yet to encounter any problems. And like all new consoles, I expect some growing pains to take place. But should we be paying $60 per a title? That is another debate in itself, but I would argue that we new what we were getting into when we purchased the xbox 360.

It's all about supply and demand, if we stopped buying the products, then eventually product spplies increase, demand plumments, and prices would follow -- or game production is haulted, and the plug is pulled on the system, ala the atari jaguar console or even more recently, Sega Dreamcast.

I have no problems with the price of the game. But 2k typically puts out cheaper games.
For all other consoles the game is sold for 39.99 a total of 10 dollars less than what a typical new game would sell for those consoles.

Although I do not mind the 60 dollar price for games I do believe that take two should of sold MLB 2k6 for 49.99 instead of 59.99 but hey baseball games aren’t hot sellers on systems and they just paid a **** load of money for this exclusive agreement they have with the players association so they're entitled to make some money back.

I also believe that if 2k doesn't fix the game in a certain time frame they should offer those of us who bought the game and ended up being nothing more than beta testers compensation for being in this unofficial beta test.

I think it is a shame that we are all being used as guinea pigs. I paid 60 dollars to play the game not test it.

I love it when people take things out of context to make a ridiculous point.

My point was, at these prices the quality of the products we buy should be better than what we are getting. There have been quite a number of game releases that have had problems immediately upon use. With reasonable QA testing, these sort of things should have not gone undetected.

And I'm not even talking about things like a batter looking left at fly ball that went to the right ... or an announcer announcing a strike against a player that isn't at bat! :-)

THAT was my point exactly. I am not looking to sue in order to be able to retire from spilling a cup of HOT coffee in my lap (ala McDonalds lawsuit). It is for the purpose of getting the attention of companies selling products that aren't going through appropriate levels of testing before they are sold on the open market, and sold without any recourse by the consumer (no refund policy). I understand the reasons for not being able to return open-box software. However, in situations such as with this game, the manufacturer should:

1) put an open statement right on the main web page of the product identifying known issues; especially within days of release and;

2) offer a refund policy for thos not willing to wait for a fix 'soon'

This company posts a 'sticky' note in a forum, to which they are assuming every customer reads the forums.

So again, I started this topic to get some discussion going and get 2K2 to open their eyes and minds. I didn't expect anyone to assume suing was a means of 'getting rich quick'.

I don't mind paying the prices if the quality of the product is as it should be.

Don't people in this country have bigger things to worry about? What about gas prices? What about the war in iraq? What about public healthcare?

Anyway, a point of clarification: The reason xbox 360 games cost more than other consoles is because of two reasons 1) the 360 is the only next-gen system out there and doesn't have to worry about competition, and 2) the xbox 360 code is a lot more cumbersome to use than current-gen systems, thus taking more man power to produce the same game on that system than on the regular xbox or ps2.

Another point of clarification for those of you waiting for a "patch" of some sort. Patching a video game is extraordinaryly difficult because patching requires that some code within the game be modified. The problem with that is that the code on your game disk is a hard copy burn which means that it cannot be altered. The only way to patch this game, or any other console game, would be to start producing other copies of the game with the modified code. Even if that is the case, people must realize that any video game has well over 100+ thousand lines of code and the problem could be anywhere. This problem isn't going to be fixed over night, or even over a weekend.

No company likes to lose customers, so I'm sure Take-Two is doing something about it. But, don't expect anything soon.

I find it funny when you complain because in the UK we have to pay $90 in shops and $80 online. And I haven't heard anyone complain about it at all.

thats true if the game sucked butt we would take the bullet but since it don't work we should get some free marketplace pts or a wbc jersey 10% off the next 2k game or something for all registerd mlb purchasers...imean if i go to mcdonalds and the burger ain't good they throw in fries or gift certificates and thats on the friggin dollar menu..when you buy a mail order russian bride if she don't tea bag then you can send her back to....er..i took that too far didn't i..you guys get the point

LOL, I totally forgot about that, those games were 60 dollars but they were so entertaining, I remember when i started playing 007 Goldeneye. WOW

EXACTLY.

2K knowingly released a broken product, and now they're shirking their responsibility to properly inform customers regarding the many issues with the game, along with updates regarding the freeze issues. Until they get their heads out of their butts and their hands out of people's wallets, they deserve all the criticism they're getting.

The world will see the truth when the PS3 comes out. Right now Magic doesn't have a Bird to keep him in check. Personally I didn't see anything THAT great about the 360 to buy it so soon. Eventually... maaaaybe. I'd rather spend $40 for frustration than $60.

Ok, I am from Iowa, After Calling the State Attorney Generals office about consumer Fraud by 2k sports, since I was on my second copy of the game and the piece of **** still didn't work. I was told that the Seller of the Game is Responsible, just like 2ksports is. So I called Best Buy where I bought it, and they explained to me that they had hear of the issue and they gave me store credit due to the fact I was past my 30 day return time, I was also told that if you bring the game back even opened due to the defect that they will refund there money and deal with 2k themselfs. This makes the stores like Best Buy, Gamestop, EB, and even nasty old Wal-Mart look bad. So my suggestion to you all, it worked for me, is return your game and let the boycott start, they will figure out that we are not going to put up with this after the attorney generals office puts out an alert, which is what is happening in this state, since myself and 3 other friends that all bought the game have written them and spoke to the State in Person. SO get your money or get a new game , just keep your reciept to prove you returned it so that you will be able to get into the class action suit that will be coming up, who knows we all might get a free game----but who knows if it will work!!!!!

All retailers are required to return it! I know WAl-Mart, Best Buy, and Game STop will take it back for sure!!!
